Cogent Biology Twitter Joke Competition 2017 Terms & Conditions

1. THE PROMOTER

    1.1. This competition is run by Cogent OA, an imprint of Taylor & Francis Group, (a trading division of Informa UK Limited), a company registered in England and Wales with company number 01072954 whose registered address is at 5 Howick Place, London SW1P 1WG (the “Promoter”).

2. THE COMPETITION

   2.1. The title of the competition is Cogent Biology Twitter Joke Competition 2017.
   2.2 .Cogent OA are awarding a prize of a Cogent Biology T-Shirt (the “Prize”) to the person who tweets us the funniest joke. The winner will be the person who sent in the joke that the Cogent OA staff deem the funniest (the “Winner”).

3. HOW TO ENTER

   3.1. The competition will run from 08:00 BST on 7th October 2017 (the “Opening Date”) to 11:59 BST on 15th October 2017 (the “Closing Date”) inclusive.
   3.2. All entries must be received by the Promoter by the Closing Date. All entries received after the Closing Date are automatically disqualified.
   3.3. To enter, follow and tweet us your biology joke at @CogentBio using the hashtag #CBioJoke by the Closing Date.
   3.4. The Promoter will not accept:

       3.4.1. responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, sever, computer hardware or software failure of any kind; or
       3.4.2.proof of transmission as proof of receipt of entry.

  3.5. By submitting an entry, you are agreeing to be bound by these terms and conditions.

  3.7. The entries will be judged by the Marketing and Editorial Team of the Journal (“Judges”) based on which joke is their favorite. The decision of the Judges  will be final.

4. ELIGIBILITY

   4.1.  In order to be eligible to participate in the competition, you must:

      4.1.1. be over the age of 16;
      4.1.2. not be an employee of the Promoter, its subsidiary and holding companies, their agents or any other person who is directly connected with the creation and operation of the competition or their immediate family; and
     4.1.3. not located in a sanctioned or embargoed country according to the International Trade Sanctions, or on an SDN/SSI list as updated from time to time.

   4.2. In entering the competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
   4.3. The Promoter will not accept entries that are incomplete.
   4.4. There is a limit of one entry per person.
   4.5 The Promoter reserves all rights to refuse your entry if your conduct is contrary to the spirit or intention of the competition.

5. THE PRIZE

   5.1. The Prize is not negotiable or transferable.
   5.2. The Winner will be contacted by the Promoter, within 3 days after the Closing Date through direct messaging on Twitter.
   5.3. In order to claim their Prize, the Winner must respond to the Promoter’s message with the size of T-shirt required and their address for free postage of Prize.
   5.4. The Prize cannot be claimed by a third party on behalf of the Winner.
   5.5. The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available, or has not claimed their Prize within 3 of days the Promoter notifying the Winner of their win, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the valid entries that were received before the Closing Date.
   5.6. The Promoter does not accept any responsibility if the Winner is unable to take up the Prize.

6. WINNER ANNOUNCEMENT

  6.1. The name and country of the winner can be viewed on Twitter, 2 days after the Winner has claimed the Prize.
  6.2. The decision of the Judges nominated by the Promoter is final and no correspondence or discussion will be entered into.

7. LIMITATION OF LIABILITY

   7.1. Insofar as is permitted by law, the Promoter, nor its parent, subsidiary, affiliated and/or related companies, or any of its or their shareholders, directors, officers, agents, employees, contractors or distributors shall be liable in any circumstances be responsible or liable to compensate the entrant or Winner, or accept any liability for any loss, damage, personal injury or death occurring as a result of entering the competition or taking up the Prize. Nothing in these terms and conditions shall exclude or restrict the Promoter’s liability for death or injury resulting from the negligence of the Promoter, or fraud and/or fraudulent misrepresentation. Your statutory rights are not affected.

8. DATA PROTECTION AND PUBLICITY

   8.1. All entrants consent to their entry or extract of their entry being posted on the Promoter’s website, https://www.cogentoa.com/ and twitter account, https://twitter.com/CogentBio
   8.2. The Winner of the competition, must consent to the Promoter using their name, image and town or country of residence to announce the Winner of this competition and for any other reasonable and related promotional purposes.
   8.3. By entering this competition, you agree that any personal information provided by you with the competition may be held and used only by the Promoter and its affiliates to administer the competition.

9. GENERAL

   9.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from this competition.
   9.2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize or competition where it becomes necessary to do so.
   9.3. You acknowledge and agree that by entering this competition, you will comply with all applicable laws and regulations including, without limitation, the Bribery Act 2010.
   9.4. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
   9.5. This competition is in no way sponsored, endorsed or administered by, or associated with Twitter
